The issue presented on appeal is whether the lower court complied with the notice and hearing requirements of Fed. R. Civ. P. 56 when it granted summary judgment for the Defendant. On May 8, 1985, appellant Geear filed suit against Boulder Community Hospital alleging that its termination of her employment violated the Age Discrimination in Employment Act of 1967, 29 U.S.C. ? 621. On September 13, 1985 the Hospital filed a motion for summary judgment to which the Plaintiff did not respond. On October 9, 1985 the Hospital requested an expedited ruling on its summary judgment motion. By order entered on October 11, 1985, more than twenty days after the motion for summary judgment was filed and served on opposing counsel, the court granted the Defendants motion. The court expressly found that "if uncontradicted, the affidavits amply support the granting of the motion" and that the appellant had failed to contradict the Defendants affidavits.
